Thank you for visiting the website of Salt River Project Agricultural Improvement and Power District and Salt River Valley Water Users’ Association (collectively “Salt River Project,” “SRP,” or “We”/ ”Our”/ ”Us”). These Website Terms and Conditions (“Terms”) apply to your interactions with this website, including My Account, and other web domains, automated phone systems, mobile apps, and online presences that SRP owns or controls (collectively, our “Digital Platforms”).     Unless otherwise indicated, the information and materials available through SRP’s Digital Platforms are the property of SRP and/or our subsidiaries and affiliates and are protected under U.S. and foreign copyright, trademark, and other intellectual property laws. No intellectual property or other rights in and to the information and materials on SRP’s Digital Platforms are transferred to visitors to our Digital Platforms.

    Use of Content

    You may not reproduce or distribute materials found on SRP’s Digital Platforms (including text, logos, graphics, sounds, or images) in any form, including by email or other electronic means, without prior written permission from SRP. Additionally, you may not frame any of the content of SRP’s Digital Platforms or incorporate it into another website or digital platform. This policy does not, however, prohibit you from emailing certain pages from SRP’s Digital Platforms to other persons where we have provided a link for that purpose.     Commercial use, broadcasting, or otherwise disseminating any content of SRP’s Digital Platforms in any media without our prior written permission is prohibited. SRP reserves the right to restrict access to its Digital Platforms and to add, discontinue, or modify any authorizations to use our Digital Platforms.

    SRP’s Digital Platforms may contain links to websites owned and operated by third parties. These links are provided to you solely as a convenience, and the inclusion of any links to third-party websites does not imply SRP’s endorsement of those third-party websites or the third party’s goods and services. Once you leave SRP's website and connect to a third-party website, you do so at your own risk, and you bear all risks and responsibilities associated with your use of the third-party websites and their goods and services.

    You agree that SRP shall not be directly or indirectly liable for any damages that arise from your use of third-party websites or the third party’s goods and services. SRP reserves the right to change or discontinue, without prior notice, any link or program it has with such third-party websites. You are free to create a text-only link to SRP's website as long as the link does not state or imply any sponsorship of your site by SRP and does not use the SRP logo without our prior written permission.     Logos

    Use of SRP's logo is not permitted without our prior written permission. To request to use our logo, send an email with detailed information about the proposed use to webmaster@srpnet.com.

    Personal Information

    The collection and use of personal information you enter in SRP’s Digital Platforms is governed by SRP’s Privacy Policy. By using our Digital Platforms, you acknowledge that you have read and agree to this Privacy Policy. SRP may modify the Privacy Policy at any time without notice or obligation and recommends checking the Privacy Policy periodically for updates.

    Account Access

    Certain areas of SRP’s Digital Platforms, such as those regarding your account information, are restricted to authorized users through the use of passwords. If we grant you authorization by way of a password to use a restricted area, you agree that you are responsible for maintaining the confidentiality of your password and account information. You also agree to immediately notify SRP of your knowledge of any unauthorized use of your account or any other breach of security in relation to the Digital Platform. Unauthorized users who access, or attempt to access, the restricted areas may be subject to prosecution. SRP reserves the right to revoke any or all access and use authorizations granted to site visitors.

    Telephone, Text, and Email Communications by SRP

    By providing your contact information to SRP, including your telephone number, email address, or any other contact information, you expressly consent to being contacted by us through calls made with an automated telephone dialing system or with a prerecorded voice, live agent, or artificial voice, text messages, and email. If you do not wish to receive communications from SRP, you may request to opt-out of receiving these communications (see our Email Subscription CenterOpen new site. for opting out of marketing emails) or contact SRP (see Contact Us below) for more information.

    Email Communications to Digital Platforms

    While we appreciate receiving email from visitors to our Digital Platforms, please note that information transmitted via email is not secure and should not be used to transmit confidential information to SRP. To ensure the protection of sensitive personal information, please refrain from including your Social Security number, driver’s license number, or other sensitive information in emails.

    Viruses or Malware

    SRP does not warrant that its Digital Platforms are free of viruses or malware. Although we take reasonable precautions to ensure no viruses or malware are present in SRP’s Digital Platforms or emails, SRP accepts no responsibility or liability for any loss or damage arising from the use of its Digital Platforms or email (including attachments) caused by viruses or malware.

    Online Conduct

    You agree to use SRP’s Digital Platforms only for lawful purposes. You are prohibited from posting on or transmitting through SRP’s Digital Platforms any unlawful, infringing, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, or otherwise objectionable, or illegal material of any kind. If SRP becomes aware of any such material provided by you, SRP may investigate and in its sole discretion remove or request the removal of such material.

    SRP reserves the right to prohibit conduct, communication, and material on its Digital Platforms that it deems, in its sole discretion, to be harmful or that violates any applicable law. Notwithstanding the foregoing, SRP cannot ensure prompt removal of questionable material after online posting. Accordingly, neither SRP, nor its officers, directors, members of its governing bodies, employees, suppliers, or agents assume liability for any action or inaction with respect to conduct, communication, or user material on SRP’s Digital Platforms.

    Liability and Indemnification

    SRP reserves the right to modify or, temporarily or permanently, discontinue its Digital Platforms with or without notice to you. You agree that neither SRP nor its officers, directors, members of its governing bodies, employees, suppliers, or agents shall be liable to you or any third party for any damage or loss caused or alleged to be caused by or in connection with the use, modification, or discontinuance of SRP’s Digital Platforms.

    You agree to indemnify and hold SRP, its officers, directors, members of its governing bodies, employees, suppliers, and agents harmless from and against any and all claims, damages, costs, and expenses, including attorneys’ fees, arising from or related to your use of our Digital Platforms or breach of these Terms.

    Disclaimer and Limitation of Damages

    SRP does not warrant the accuracy, completeness, timeliness, noninfringement, merchantability, suitability, or fitness for a particular purpose of the information and materials made available through SRP’s Digital Platforms. All Digital Platforms are provided on an “as is” basis.

    To the maximum extent permitted by applicable law, in no event shall SRP or its officers, directors, members of its governing bodies, employees, suppliers, or agents be liable for any special, indirect, incidental, or consequential damages whatsoever arising out of or resulting from (i) the use of, or inability to use, data, documents, or information made available on this site or other websites linked to or from this site, or (ii) content errors, omissions, or infringing material, including without limitation lost profits, damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other damages or losses, even if SRP is advised of the possibility thereof and regardless of the legal or equitable theory, whether in contract, tort, or otherwise, upon which the claim is based.

    SRP may make improvements and/or changes to any product(s) or service(s) described in SRP’s Digital Platforms at any time. SRP does not guarantee that any product or service described in its Digital Platforms will be continuously available. The information on its Digital Platforms is periodically updated.

    The documents and related graphics published on SRP’s Digital Platforms could include typographical errors or technical inaccuracies.

    Governing law

    These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflicts of law principles. You agree that any action, suit, or proceeding arising out of or relating to these Terms or the use of any of SRP’s Digital Platforms shall be initiated and prosecuted in a state or federal court of competent jurisdiction located in Maricopa County, Arizona, and you irrevocably submit to the jurisdiction of any such court. Any cause of action you may have with respect to SRP’s Digital Platforms or their content must be commenced within one (1) year after the claim or cause of action accrues and any claim must be filed within one hundred eighty (180) days after the claim or cause of action accrues in accordance with A.R.S. sections 12-821 and 12-821.01. To the fullest extent permitted by law, you irrevocably waive any and all rights to a trial by jury and covenant and agree not to request a trial by jury with respect to any legal proceeding arising out of or relating to these Terms, or the use of SRP’s Digital Platforms.

    SRP’s failure to require or enforce strict performance of any term or condition of these Terms or to exercise any right under these Terms shall not be deemed a waiver or relinquishment by SRP of any of its rights hereunder.

    Your use of SRP’s Digital Platforms is subject to any additional disclaimers and notices that may appear throughout this website or our other Digital Platforms and any other agreements between you and SRP regarding information available on, in, or through this website or the other Digital Platforms.
